A. The Limited Power of Attorney Form grants authority from one person (“Principal”) to another (“Attorney-in-Fact”) for a specific matter. Limited power of attorney is VOID if Principal becomes incapacitated.

How to Void Power of Attorney?

Q. How to Void Power of Attorney?

A. There are FOUR Major ways to void a power of attorney form.

1. Throw It Away – A power of attorney form is not filed with the state, meaning that you hold all the evidence. And if you get rid of the evidence, then the power of attorney form never existed (legally anyway). So throw you original power of attorney form along with any and all copies in the trash and burn it!

2. Make a New One – If the principal in power of attorney wants to change his attorney-in-fact, then all he/she has to do is make a new power of attorney form. If you show up at an attorney’s office or at the hospital with two power of attorney forms, the power of attorney form that was done the most recently is the one valid.

3. Power of Attorney Revocation – If you don’t know where all your power of attorney forms are, just sign a power of attorney revocation form. Upon signature of this form, all power of attorney forms are void. Be sure to give a copy of this to your attorney or a representative of you, in the chance that you may be incapacitated and someone decides to use an old power of attorney form against you.

4. Die – If you die, Power of Attorney becomes void although it is not advised.
