Hi, my nan died 5 years ago and her will has been read, there are 2 executors and 12 (i think) beneficiaries. After 5 years the executors still haven’t done anything about sorting out her will as they now dont get along and both want to use their own lawyers and are now at a stale mate with not seeming to want to do anything about it. She left her estate to the people named, what I am trying to find out is as a beneficiary of the will is there anything I can do to make them get it done, or to legally take over as executor of the will? I cannot afford to pay any lawyers but I think its getting silly, and there must be something that can be done after 5 years, it seems as this is never going to get sorted.
Many thanks in advance if anyone can help me out
Processing a will can be a complicated affair for an executor particularly if there are disputes.
But if you are an Executor you are governed by law to Proceed with due care because you are accountable to the court who issued the Grant of Probate and expected to complete your duties in reasonable time.
If you believe that the executors are not doing their job either properly or diligently, you should write to the executors asking for a statement of account and an explanation of any delays which are effecting the distribution of the assets.
As Executors they are legally required to comply with any reasonable request from anyone with an interest in the estate. You may also contact the Probate Office and ask their advice but I’m not sure they are able to give legal advice.
